5th Circuit Upholds Damage Caps

(Reuters) - A federal appeals court has upheld Mississippi's $1 million cap on what people can recover for pain and suffering in a case with direct bearing on pharmaceutical product liability and medical malpractice cases.
A three-judge panel of the 5th U.S. Circuit Court of Appeals in New Orleans rejected a challenge brought by Lisa Learmonth, a woman injured in a car wreck who said the $1 million cap was unconstitutional and violated her right to a jury trial.
